Terms & conditions
The terms and conditions applicable to our services and agreements.
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- ComfortCV: the company providing services in the field of boilers, established in [place], Chamber of Commerce number [CoC number].
- Client: the natural or legal person entering into an agreement with ComfortCV.
- Agreement: any arrangement between ComfortCV and the client for the supply of services or products.
- Services: the purchase, supply, installation, maintenance and repair of boilers and related work.
Article 2 – Applicability
These terms and conditions apply to all quotations, offers, agreements and deliveries by ComfortCV, unless otherwise agreed in writing. Any terms and conditions of the client are expressly rejected.
Article 3 – Quotations and offers
- All quotations are without obligation and valid for [e.g. 30 days], unless otherwise stated.
- Quotations are based on information provided by the client. In the event of incorrect or incomplete information, the price may be adjusted.
- Obvious errors or mistakes in a quotation are not binding on ComfortCV.
Article 4 – Formation of the agreement
The agreement is formed at the moment the client accepts a quotation or order, whether in writing or verbally, or as soon as ComfortCV begins carrying out the work.
Article 5 – Performance of the work
- ComfortCV carries out the work to the best of its knowledge and ability and in accordance with applicable standards.
- The client ensures that ComfortCV has timely and safe access to the workplace and the necessary facilities (such as electricity, water and gas).
- Stated completion times are indicative and do not constitute a strict deadline.
Article 6 – Prices and call-out fees
- All prices are in euros and inclusive of VAT, unless stated otherwise.
- No call-out fees are charged within ComfortCV's service area, unless otherwise agreed.
- Any additional work that proves necessary during the execution of the assignment will be discussed with the client in advance and charged separately.
Article 7 – Payment
- Payment must be made within [e.g. 14 days] of the invoice date, unless otherwise agreed.
- In the event of late payment, the client is in default by operation of law and statutory interest and collection costs may be charged.
Article 8 – Warranty
- Supplied boilers are subject to the manufacturer's warranty as provided by the manufacturer.
- ComfortCV provides a warranty on installation and assembly work for [e.g. 12 months], provided the appliance is used and maintained in accordance with the instructions.
- The warranty lapses in the event of improper use, modifications by third parties or failure to carry out required maintenance.
Article 9 – Liability
- ComfortCV's liability is limited to the amount paid out by the insurer in the relevant case, or to the invoice amount of the relevant assignment.
- ComfortCV is not liable for indirect damage, consequential damage or damage caused by force majeure.
Article 10 – Force majeure
ComfortCV is not obliged to fulfil any obligation if it is prevented from doing so by force majeure, which includes, among other things: illness, strikes, transport problems, supply problems from suppliers and government measures.
Article 11 – Complaints
Complaints about the work carried out must be submitted to ComfortCV in writing within [e.g. 14 days] of completion. We strive to resolve complaints within a reasonable timeframe.
Article 12 – Governing law
All agreements with ComfortCV are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the district where ComfortCV is established.
